The Harvey Mirsky Collection of the United States 1847 Issue continued...

Canadian and B.N.A. Mails, 1851 Treaty Rates and Post-Demonetization
Lot Sym. Lot Description
2473 c Image10c Black (2). Position 23L1, large margins to just in, bright shade, tied by blue "Philada. Pa. 5cts. Apr. ?" integral-rate circular datestamp on folded letter datelined "Philad. 4th April 1851" and addressed to Montreal, Canada, also with sender's manuscript "Paid to the lines" notation at top, minor splitting along vertical file fold which is well away from stamp

VERY FINE. A WONDERFUL USE OF THE 10-CENT 1847 ISSUE ON A COVER SENT PRIOR TO THE START OF THE APRIL 1851 TREATY BUT ACCEPTED AS A TREATY RATE USE. THIS IS THE EARLIEST REPORTED TREATY RATE COVER.

Effective April 6, 1851 a new rate was established between the United States and Canada. Mail was no longer prepaid just to the border, a rate of 10c (or 6 pence Canadian) was established to or from any place in Canada (except for the West Coast). The sender of this letter was apparently unaware of the impending rate change and marked it "paid to the lines". However, by the time his letter arrived in Canada the new treaty was in effect, so it was considered fully prepaid to destination.

2476 c Image5c Red Brown (1). Beautiful warm shade (approaching Orange Brown of late printings), large to huge margins except at top where close, tied by two bold blue grid cancels, matching "Troy N.Y. Apr. 23" circular datestamp on 1851 folded letter to Perth, Canada West, stamp placed one inch from right edge with manuscript "Due 5" in blank space, manuscript "Via Cape Vincent or Ogdensburgh N.Y." routing instructions, sent via Ogdensburgh as evidenced by red "U. States" in arc with shield, manuscript "3" pence Canadian due

FRESH AND VERY FINE. ONE OF THE RAREST OF ALL UNITED STATES AND CANADIAN CROSS-BORDER FRANKINGS.

The treaty rate of 10c U.S. or 6p Canadian began on April 6, 1851. The 1847 Issue was demonetized on July 1st, leaving a brief period in which 1847 stamps could be used to prepay the treaty rate. This cover is very unusual, because it shows the 5c 1847 prepaying U.S. postage with Canadian postage collected in cash. The treaty specified that letters had to be entirely prepaid or sent collect. The cover offered here is unusual because the part payment of 5c was accepted. The counterpart to this franking is the legitimate combination of a 5c 1847 and Canada 3p Beaver.

States" in arc handstamp, receiving backstamp, stamp "tied" by vertical file fold, small tear at right

VERY FINE APPEARANCE. THIS IS THE ONLY RECORDED DEMONETIZED USE OF THE 1847 ISSUE TO CANADA, AND ONE OF VERY FEW SENT TO A FOREIGN DESTINATION AFTER JULY 1, 1851. A WONDERFUL POSTAL HISTORY RARITY.

Effective July 1, 1851, the basic letter rate was changed to 3c for domestic letters sent up to 3,000 miles, and 6c for letters sent over 3,000 miles. New stamps were issued to accommodate the new rates, and the old stamps were demonetized and considered invalid for postage after June 30, 1851. Approximately seven are known used from Canada after demonetization. Three others are known to France, each with a single 5c stamp, and two are known to Mexico, each with a strip of three of the 10c. This cover was the subject of Chronicle articles in Aug. 1999 and May 2007 (copies accompany).
